Terms of Service

Last updated:

These Terms of Service ("Terms") are an agreement between MyGaragio ("MyGaragio", "we", "us") and the business that creates a MyGaragio account ("you", "your shop"). They apply to the MyGaragio software, the website at mygaragio.com and everything we provide with them (together, the "Service").

By creating an account, starting a trial or using the Service, you accept these Terms on behalf of your business. If you do not agree, do not use the Service.

1. Who can use MyGaragio

MyGaragio is built for businesses — independent auto repair shops and similar businesses — not for personal or household use. The person who accepts these Terms confirms that they are at least 18 years old and are authorized to bind the business.

Each subscription covers one shop location. A business with several locations needs one account per location; linked locations can share information through the multi-location features.

You are responsible for the people you invite (owners, managers, advisors, technicians, bookkeepers), for what they do in your account and for keeping sign-in details confidential. We recommend turning on two-step sign-in for everyone who can see financial information.

2. The Service

MyGaragio is cloud software for running a repair shop: repair orders and invoices, digital inspections, scheduling and online booking, customer messaging, parts and inventory, payments, reports and the features described on our website. We improve the Service continuously; we may add, change or retire features, and we will tell you ahead of time when a change removes something important you use.

Features marked beta or preview are offered as they are, may change quickly and are excluded from any commitment in these Terms.

We work to keep the Service available at all times and fix problems quickly, but we do not guarantee uninterrupted availability. Planned maintenance is done outside usual shop hours when possible. Parts of the technician app keep working without a connection and send their changes when it returns.

3. Free trial

Every new shop starts with a 30-day free trial, with no credit card. The trial includes the whole product; the monthly allowance for AI features is smaller during the trial.

At the end of the trial you can subscribe to keep going. If you don’t, your account becomes read-only: you can still sign in, see and export everything, but not add or change records. We keep your data for 60 days after that, remind you before it is deleted, and then delete it as described in section 6.

4. Subscription, payment and cancellation

Price. The subscription price is shown on our pricing page and at checkout, monthly or yearly, in Canadian dollars for shops in Canada and in US dollars elsewhere. Sales taxes (GST/HST, QST, PST or US sales tax) are added where they apply.

Renewal. Subscriptions renew automatically at the end of each month or year until cancelled. Payment is taken in advance by our payment processor, Stripe; we never see or store your full card number.

Cancelling. You can cancel at any time from your account’s billing settings. Cancellation takes effect at the end of the period already paid; until then the account keeps working. Except where the law requires otherwise, payments are not refunded for partial periods.

Price changes. We will give you at least 30 days’ notice by email before a price change applies to your subscription; it takes effect at your next renewal after that notice.

Failed payments. If a payment fails, we tell you and retry. After a 7-day grace period, the account becomes read-only until the payment is made; your data is not deleted while you can still pay.

Costs of other services. Text messages through your own Twilio account or phone plan, card processing on your own Stripe account, card readers, and parts or services you buy from suppliers are billed by those providers, not by MyGaragio.

5. Your data

You own your data: the information about your shop, your customers, their vehicles, your work, your prices and your documents. You give us the permission we need to host, copy, process and display that data in order to provide the Service to you, to keep it secure and backed up, and to support you — nothing else.

For the personal information your shop keeps about its customers and staff, you are the person responsible for it (the "controller") and MyGaragio acts on your behalf as your service provider (the "processor"). Our Data Processing Addendum forms part of these Terms and describes how we handle that information.

You can export your data at any time, including a full copy of your database with every photo and document, from your account settings.

We may use aggregated, de-identified statistics about how the Service is used (for example, how many inspections are sent each month across all shops) to run and improve it. Such statistics never identify you, your customers or your staff.

6. Closing your account and deleting data

An owner can ask to delete the shop’s account from the account settings or by writing to us. To protect against mistakes and unauthorized requests, deletion starts after a 7-day cooling-off period during which the request can be cancelled and the data exported. When deletion takes place, the shop’s data is removed from our live systems. Photos and documents remain only in the server’s daily snapshots, which are erased after 7 days, and in the off-site copy of the files, where they are erased after 30 days. In our encrypted backups (daily copies are kept for 30 days and monthly copies for 12 months), a deleted shop’s monthly copies are removed the next night and its daily copies after 30 days, then 30 more days in the versioned bucket: the last ones no later than 62 days after deletion. Until then they are used only to recover the service after a loss of data.

When a subscription ends (or a trial ends without one), the account stays read-only for 60 days and is then deleted the same way, after a reminder.

We may keep limited records we are legally required to keep (for example, our own invoices to you) for as long as the law requires.

7. Your responsibilities

  • Your documents. You are responsible for the accuracy of your estimates, invoices, prices and taxes, and for the legal notices and consumer-protection rules that apply to your shop (for example, Quebec’s written-estimate rules for repairs). MyGaragio provides tools; it does not give legal, tax or accounting advice.
  • Your messages. You are responsible for having consent to send each text, email or call made from your account, and for the content of your messages. Read our Text Messaging Rules (CASL in Canada; TCPA and carrier registration in the US) and our Acceptable Use Policy.
  • Your customers’ information. You collect your customers’ information lawfully, tell them how you use it (your own privacy notice) and answer their requests to access, correct or delete it. Our tools help you do this.
  • Your other accounts. Integrations you connect — Stripe, Twilio, QuickBooks, parts suppliers and marketplaces such as PartsTech or eBay, your own email server — are agreements between you and those companies. Their terms and fees apply to you.
  • Your equipment and connection. You provide the devices, browsers and internet access your team uses.

8. AI features

MyGaragio includes AI features (for example, the assistant, writing help, reading photos and supplier quotes, and the text and voice receptionists). They are included in the subscription with a monthly allowance per shop; when the allowance is reached, those features switch to their offline behaviour until the next month.

AI output can be wrong. You and your team review estimates, diagnostic suggestions, messages and other output before relying on them or sending them to customers. The receptionists answer from your shop’s data and settings; you decide what they may do, and you tell callers and texters that an automated assistant may answer, and that calls may be recorded or transcribed, wherever the law requires it.

To provide these features, the information needed for each request is sent to our AI provider (listed on our Subprocessors page) under terms that do not allow it to train its models on your data. An owner can turn AI features off for the shop at any time.

9. Acceptable use and suspension

You agree to follow our Acceptable Use Policy, which forms part of these Terms.

We may suspend all or part of an account, with notice when reasonable, if payment is overdue past the grace period, if the account is used in breach of these Terms or the Acceptable Use Policy (for example, unsolicited messaging), if it puts the Service or other shops at risk, or if the law requires it. When we suspend for a reason other than an emergency, we tell you why and how to fix it; you keep the ability to export your data unless the law prevents it.

10. Term and termination

These Terms start when you accept them and continue until your account is closed. You may stop using the Service and cancel at any time (section 4). We may end the agreement with at least 30 days’ notice, or immediately for a serious breach that is not fixed after notice, for repeated breaches, or where the law requires it.

Sections about your data, deletion, payment of amounts owed, intellectual property, confidentiality, disclaimers, liability, indemnity and governing law continue after the agreement ends.

11. Intellectual property and feedback

MyGaragio and its software, design and content (other than your data) belong to us and our licensors. We grant you a non-exclusive, non-transferable right to use the Service for your business during your subscription. You may not copy, resell, reverse engineer or build a competing product from the Service, except where the law expressly allows it.

If you send us suggestions or feedback, we may use them freely to improve the Service, without obligation to you.

12. Confidentiality and security

Each party keeps the other’s confidential information confidential and uses it only for this agreement. Your data is your confidential information.

We protect your data with the technical and organizational measures described on our Security page and in the Data Processing Addendum, and we tell you without undue delay if a confidentiality incident affects it.

13. Disclaimers

We provide the Service with care and skill. Apart from what these Terms say, and to the extent the law allows, the Service is provided "as is" and "as available", without other warranties, express or implied, including fitness for a particular purpose. Nothing in these Terms excludes a warranty that cannot be excluded by law.

14. Limitation of liability

To the extent the law allows: (a) neither party is liable for indirect, special or consequential damages, loss of profits, revenue or goodwill; and (b) each party’s total liability arising from this agreement is limited to the amounts you paid MyGaragio in the 12 months before the event giving rise to the claim. These limits do not apply to your payment obligations, to a party’s gross or intentional fault, or where the law does not permit them.

15. Indemnity

You will defend and indemnify MyGaragio against claims by third parties arising from messages you send, content you upload, or your use of the Service in breach of these Terms or the law, and pay the resulting damages and reasonable costs.

16. Changes to these Terms

We may update these Terms. For a material change, we will notify account owners by email and in the app at least 30 days before it takes effect; the "Last updated" date at the top shows the current version. If you don’t accept a material change, you can cancel before it takes effect. Other changes (clarifications, new features) apply when published.

17. Governing law and disputes

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada that apply there. The courts of the judicial district of Montréal, Quebec, have exclusive jurisdiction, unless the law gives you the right to go to another court. Before going to court, both parties will try in good faith to settle a dispute by writing to each other.

18. Language

These Terms are available in French and in English: read the French version.

19. General

  • Notices. We send notices to the account owner’s email address; you send notices to the address in section 20.
  • Assignment. You may not transfer this agreement without our consent, except with the sale of your business. We may transfer it to a successor of our business, with notice.
  • Force majeure. Neither party is responsible for delays caused by events beyond its reasonable control (outages of major internet or hosting providers, natural disasters, government action).
  • Entire agreement. These Terms, with the Data Processing Addendum, the Acceptable Use Policy and the Text Messaging Rules, are the whole agreement between us about the Service. If a part is found unenforceable, the rest remains in effect.
